TERMS OF DISTANCE SELLING AND TERMS OF USE

These Distance Purchase Terms and Conditions of Use regulate the rights and obligations between the company Brew Society doo, with registered office at Uroša Martinovića 9, 11070 Belgrade, Republic of Serbia, as the seller, and customers who order goods via the online store brewsociety.store.

By using the website, browsing products, creating an order, and confirming a purchase, the customer confirms that they are familiar with these terms and accept them in their entirety.

2. Subject of Sale

The seller offers products related to coffee preparation through the website, including, but not limited to: espresso machines, coffee grinders, additional equipment, accessories, cups, spare parts, and other related products.

All products displayed on the website strive to be described as accurately as possible, including their basic characteristics, price, availability, and potential delivery times. The seller reserves the right to technical errors in the description, display of photos, prices, and product availability, with the obligation to correct such errors without delay.


3. Prices and Price Display Method

All product prices on the website are stated in Dinars (RSD), unless explicitly stated otherwise on the website.

VAT is included in the product price, unless otherwise specified on the website for a particular product or legal basis.

Delivery costs, if any, are displayed separately during the ordering process, before final purchase confirmation.

The seller reserves the right to change prices without prior notice. The price displayed at the time of order confirmation is binding for the buyer.


4. Conversion Statement

All payments are made in the currency of the Republic of Serbia – Dinar (RSD). For informative display of prices in other currencies, the middle exchange rate of the National Bank of Serbia may be used. The amount for which the customer's payment card will be charged may be displayed in the user's local currency through conversion at the exchange rate applied by card organizations, which is unknown to the seller at the time of the transaction. Due to this conversion, a slight difference from the price displayed on the website is possible.


5. Ordering Process

Purchasing on the website is done by selecting products, adding them to the cart, entering order details, choosing a shipping method and payment method, and then confirming the order.

Before completing the purchase, the customer is shown an order overview containing at least:

  • product name,
  • quantity,
  • unit price,
  • total product price,
  • possible delivery costs,
  • total amount to pay.

The purchase is considered concluded only after the customer confirms the order and gives explicit consent to these terms.


6. Explicit Customer Consent

Before completing the order, the customer is obliged to confirm that they are familiar with and agree to these Distance Purchase Terms and Conditions of Use, including rules on delivery, complaints, privacy, transaction data protection, and refunds.


7. Payment Methods

The customer can pay for the goods using one of the methods offered on the website at the time of purchase, including:

  • payment cards via secure processing,
  • bank transfer, if that option is available for the specific order,
  • other methods if specifically listed on the website.

If the customer pays by credit card, they will be redirected to a secure page of the payment processor/bank to enter card details.


8. Delivery of Goods and Possible Limitations

The seller delivers goods within the Republic of Serbia, and possibly to other territories if specifically enabled and indicated during the purchase process.

Delivery is carried out via a contracted courier service or another appropriate method, depending on the type of product, delivery location, and logistical conditions.

For products marked as in stock, the estimated delivery time is usually 1 to 5 business days from order confirmation, unless a different period is stated for a specific product.

For products that are out of stock, available for order, on backorder, or for which an extended delivery time is specifically indicated, the delivery time may be longer and will be stated on the product page, in the cart, in the order confirmation, or through direct communication with the customer.

The customer is responsible for entering accurate delivery information. The seller is not liable for delays or inability to deliver caused by incorrectly entered information, recipient's absence, refusal to accept the shipment, or other circumstances beyond the seller's control.

Delivery may be limited or delayed due to:

  • force majeure,
  • transport disruptions,
  • supplier delays,
  • customs or import procedures,
  • temporary product unavailability,
  • special security or technical requirements for certain products.

For goods with special restrictions regarding transport, import, export, service, installation, or legal sales regime, the customer will be informed before concluding the purchase or without delay after receiving the order.


9. Order Confirmation and Payment Confirmation

After a successfully recorded order, the customer receives an order receipt confirmation to the email address provided during the purchase.

After successful payment, the customer may also receive a payment confirmation containing relevant order and transaction details.

In case of unsuccessful payment, the customer will be informed that the payment was not successful and that the account was not charged, i.e., that they should try again or contact their bank if the problem persists.


10. Right to Withdraw from a Distance Contract

A customer who is considered a consumer, within the meaning of the applicable regulations of the Republic of Serbia, has the right to withdraw from a distance contract within the legal period, without stating reasons, except in cases where this right is excluded by law.

To exercise the right of withdrawal, the customer must send an unambiguous statement of withdrawal to the seller via email at support@brewsociety.store or in writing.

The withdrawal period begins on the day when the goods are delivered to the customer or a third party designated by the customer, who is not the carrier.

The customer is obliged to return the goods without undue delay, and no later than the legal deadline from the day the withdrawal statement was sent, to the address provided by the seller in response to the withdrawal request.

The customer bears the direct costs of returning the goods, unless otherwise agreed or the seller has explicitly taken over these costs.

The customer is liable for any diminished value of the goods resulting from handling the goods in a way that is not necessary to ascertain their nature, characteristics, and functionality.

The right of withdrawal does not apply in cases prescribed by law, including products made to the customer's specific specifications, sealed goods unsuitable for return due to health or hygiene reasons if unsealed after delivery, as well as other legally provided exceptions.


11. Complaint Policy

The customer has the right to submit a complaint regarding product conformity, damage in transit, incorrectly delivered goods, defects, or other grounds provided for by the applicable regulations of the Republic of Serbia.

Complaints are submitted:

It is desirable that the complaint contains:

  • customer's first and last name,
  • order number,
  • description of the problem,
  • photos of the product and packaging, where possible,
  • contact details for a response.

The seller will confirm receipt of the complaint without delay and act on it in accordance with legal deadlines and rules.

In the case of a justified complaint, the customer can exercise rights provided by law, including repair, replacement, price reduction, contract termination, or other rights arising from the nature of the specific case.

If the product is damaged during transport, the customer should, if possible, report the damage immediately upon receipt of the shipment and keep the packaging to facilitate the ascertainment of the factual situation.


12. Service, Warranty, and Technical Support

For products that have a warranty period, the warranty conditions will be stated with the product, in the warranty card, on the invoice, or in other accompanying documentation, in accordance with the law and the manufacturer's/distributor's policy.

The customer is obliged to use the product in accordance with the manufacturer's instructions. Damage caused by improper use, unauthorized servicing, inadequate maintenance, or mechanical damage is not the seller's responsibility, except when otherwise stipulated by law.


13. User Privacy Protection

Brew Society doo undertakes to protect the privacy of all its customers and website users.

Only data necessary for order fulfillment, communication with the customer, goods delivery, invoicing, complaint resolution, and improvement of user experience are collected, in accordance with applicable regulations and good business practices.

Customer data is kept confidential and is only accessible to employees and engaged persons who need this data to perform business tasks. The customer is given a choice regarding the receipt of marketing messages and participation in marketing activities.

 

14. Protection of Confidential Transaction Data

When entering payment card data, confidential information is transmitted over a public network in a protected, encrypted form, using modern security protocols.

The security of data during purchase is guaranteed by the payment card processor and the bank through which payment is made, so the entire authorization and payment process takes place on the protected pages of the bank or authorized processor.

Brew Society doo at no point has complete payment card data of the customer, nor does it store, process, or archive it in its system.


15. Refunds

In the event of a justified order cancellation, withdrawal from the contract, complaint, or other basis for a refund, the refund will be made in accordance with applicable regulations and card scheme rules.

If the purchase was paid by credit card, the refund will be made exclusively to the payment card account used for the payment, i.e., by reversing or refunding the original transaction, in accordance with the bank's and payment processor's procedure.

It is not possible to make a cash refund, to another current account, or to a payment card not used for the original transaction, unless explicitly prescribed by mandatory rules or an order from a competent authority.


16. Responsibility for Website Content and Availability

The seller strives for the information on the website to be accurate, complete, and up-to-date, but does not guarantee that the website will be available at all times without interruption, error, or technical downtime.

The seller is not responsible for temporary unavailability of the website, technical errors, problems with internet connection, third-party errors, or other circumstances that may affect the use of the website, except to the extent that such responsibility is mandatory by law.


17. Intellectual Property

All content published on the website, including texts, photographs, logos, graphic elements, product descriptions, design, and other materials, constitutes the intellectual property of the seller, its partners, manufacturers, or rights holders and may not be used, copied, distributed, or published without the prior consent of the rights holder, except when permitted by law.


18. Governing Law and Dispute Resolution

These terms, as well as all contracts concluded through the website, are governed by the law of the Republic of Serbia.

In the event of a dispute, the parties shall endeavor to resolve the dispute amicably. If this is not possible, the materially competent court in the Republic of Serbia shall have jurisdiction to resolve the dispute, unless other jurisdiction is stipulated for the consumer by applicable regulations.


19. Changes to Terms

The Seller reserves the right to amend these Distance Purchase Terms and Conditions of Use at any time.

Changes shall come into effect upon publication on the website. Purchases made before the amendment of the terms shall be subject to the version of the terms valid at the time the order was placed.
